The Chartered Professional Accountants of BC Act was proclaimed on June 24, 2015. Under section 81 of the Act, discipline cases where the panel has been struck but the hearing had not concluded prior to proclamation may conclude under the legacy process. Therefore, this decision is issued by the CGA-BC Discipline Committee.
Complaint
CGA-BC received a complaint against CGA-BC Student, Mr. Gaganpreet Basi (Mr. Basi), from his former employer, alleging he forged a signature on a medical leave certificate. Also outlined in the complaint were concerns that Mr. Basi may have submitted his work experience to CGA-BC, without his employer’s knowledge or approval.
Decision
On September 15, 2015, the Discipline Committee Panel found that Mr. Basi was in breach of CGA-BC’s Code of Ethical Principles and Rules of Conduct, in effect from September 20, 2014, as follows:
Rules R101 – Discredit, R606(a) – Detrimental Actions, R102 – Unlawful Activity, R108 – Conduct Unbecoming; and R402– Association with Financial and Other Information because:
- Mr. Basi forged the signature of a medical doctor and this act is considered a fraudulent activity;
- As a student in the CGA Program of Professional Studies and by virtue of committing the alleged forgery of a medical certificate and submitting this to his employer, Mr. Basi brought discredit to the Association and the accounting profession;
- He perpetrated the fraud by submitting false information on a medical certificate to his employer; and
- He created false documentation in an attempt to extend his medical leave from work.
Discipline Order
- Removed from enrolment as a CGA student for 5 years from the date of this decision;
- Ordered to pay a fine in the amount of $2,000; and
- Ordered to pay partial costs in the amount of $1,980.
