Over a lengthy period, the Member made numerous voice recordings at their previous place of employment. The recordings were made without the knowledge or consent of the individuals involved and captured personal details of fellow employees and confidential company information in various forms.

The Member asserts that the recordings were made to document alleged workplace misconduct. The Member initiated legal proceedings against their former employer for wrongful dismissal. The Court was critical of the Member’s behaviour.

The Investigation Committee determined the Member contravened the CPABC Code of Professional Conduct following Rules:

201.1 - Maintenance of the good reputation of the profession
202.1 - Integrity and due care
208.2 - Confidentiality of information

The Investigation Committee recommended the Member:

  1. Accept a reprimand; and
  2. Pay partial expenses of $1,000.

In making this recommendation, the Committee considered the Member’s personal circumstances.
